ARTICLE 1, PREAMBLE

Us, together as a whole, as the DCP and the United Servers of the DCP, join together in unity to establish justice and enhance security to the world of club penguin armies for the greater of all penguin-kind.

ARTICLE 2, MISSION STATEMENT

The DCP and the United Servers of the DCP will fight for peace and defend for justice. As well as fighting for justice and defending for peace.

ARTICLE 3, DEMOCRATIC STATEMENT

Section A: Statement

The United Servers of the DCP is classified as a Democratic Republic government system, meaning that the presidents are elected with a vice president to follow behind and a Prime Minister to ensure balance and stability. Senate members are also elected, and the judicial court system are elected with a chief justice appointed by the president. No person is above each other, creating an even government.

Vice Party Leader: The Current VP
Senators:
Beliefs: We believe that DCP should be ruled by fair but firm leaders, rules MUST be enforced, punishments must be severe. We believe in expansionism. Justice must be upheld, the President must have the final say in all matters. Traitors will be shot.

Democrat:

Vice Party Leader: N/A6
Senators:
Beliefs: Rules should be enforced, but with fair reason and trial. Everyone must have the right to freedom of speech although limited when obscenities such as racism occur. Views from the lower ranks should always be considered and soldiers should always have basic rights to enjoy their experience at DCP.

4, DEMOCRATIC POSTIONS

Section A: Executive Branch

Supreme Leader: N/A as we have not been declared Dictatorship.

May only be declared when the Senate unanimously votes to create a Leader or the President- Supreme Leader. The suggestion for this post must come from a person of the executive branch. In the case of a Supreme Leader, they become the Supreme Authority of DCP. However they may take advice from other members of the government. A Supreme Leader may only be impeached by the unanimous decision of the Senate or a populist coup. If the Supreme Leader resigns, the government will revert to a Democratic Republic.

President:

He/She is elected, and is the leader of the armed forces. This person serves for an unlimited term and can be removed from their position by impeachment, resignation, or death. The President can be re-elected. In special circumstances, a Commander of the Army may be appointed *Supreme Leader* this happens when the Senate unanimously votes and in effect makes the government a Dictatorship. Refer to the above

Prime Minister:

He/she is appointed by the President and makes sure the government adheres to the checks and balances of the nation. They are de facto third in command of the nation, the Prime Minister may take emergency power in cases of extreme circumstances. He/She is the people’s voice in the DCP, and has the power to demand democratic elections if the circumstances are provided.

Vice President:

He/She is the President’s previous running mate, and is second under the leader of the armed forces. This person serves for a 6 month term and can be removed from their position by impeachment, resignation, or death. The Vice President can be re-elected along with the President.

Secretary of State:

He/She is appointed by the President and is under the command of the President and Vice President. This person informs other soldiers of things that the President or Vice President is unavailable. This person serves for as long as the president and vice president, and leaves office if the President is impeached and if both the President and Vice President resign.

Attorney General:

This person makes sure that the constitution is obeyed to the word, they have the power to decide if something is unconstitutional and in confusion about the constitution they have the final decision- Regardless of the Supreme Leader or Presidents view-. In times of crisis when the Prime Minister, President and VP are all proven to be corrupt or fired, the Attorney General may take power. The Attorney General may also demand members of the Senate to be fired if there are reasons.

Ambassador:

This person represents the Nation in foreign affairs, they have the power to broker treaties and create alliances with other armies, they may also stop communications with another army.

Section B: Minor Government Officials

Minister of Communications (Xat):

Section B: Legislative Branch

Head of the House: N/A

This person, is chosen by the President. And can be impeached by the Senate or the President. This person is designated to keep things on task and in order and pass the approved bill to the president and/or vice presidents.

Head Senator: N/A

This Person is the leading Senator and makes sure the Senate efficiently executes it’s powers, they have the power to reject legislation from the Senate but may once again be fired by the Secreatery of State

Senators: N/A

These people, are the main body of the senators. Up to 9 senators can take this position. They are elected by the people of U.S.G.T And serve for 3 months. They can be elected again at the next election. These people, approve or veto bills or laws by a majority rule vote based upon the graphic organizer by the Head Senators that displays the positive’s and negative’s of the proposed law.

Section C: Judicial Branch

Chief Judge: N/A

This one person, is nominated by the President and confirmed by the Senate. They serve for life and can only be removed by death, resignation or impeachment.

Judges: N/A

These 3 People, are nominated by the President and confirmed by the Senate. They serve for life and can only be removed by death, resignation or impeachment.

ARTICLE 5, DEMOCRATIC RESPONSIBILITIES

Each Democratic person is responsible for fulfilling their duty to their fullest. If they fail at fulfilling their duties, they can resign or be impeached. The government has many ways of being impeached, including the following; rebellions/revolutions and petitions. Once a rebellion/revolution or petition is presented to the Prime Minister or Senate (not addressing to the person wanted for impeachment) Then the group can make the final decisions and appoint a replacement or have another election.

Each of the branches of the Government must make a decision on bills proposed by the legislature. If a bill is not vetoed within 48 hours of the proposal by the 3 branches of the government, then the bill will be passed. If there is a fault in the bill after it has been passed, then there must be another bill presented to the legislature to remove the passed bill.

Section B: Governors

ARTICLE 7, NATIONAL LAWS, RIGHTS,  AND PUNISHMENTS

Each and every member in the DCP and the United Servers of the DCP has the right to their freedom of speech, press, religion, and opinions. This right is limited when it comes to obscenities including sexism, racism, swearing and cursing, violence, and inappropriate actions/topics. (See Amendment 1)

  • Each and every member in the DCP and the United Servers of the DCP has the right to call for a court trial when a law is broken, only if the problem can not be solved on their own. The members also have a right to a fair jury if one is available.
  • In any case shall there be any vulgar actions including sexism, racism, swearing, fighting, flaming, cursing, violence, and inappropriate topics/actions unless they are against an enemy. Punishment for civil disputes will result in 2-7 days of suspension.
  • Suspensions are to be a punishment used for minor cases. During a suspension a member is limited to some of their rights.
  • No man is ever above the law. Everyone is punishable by the law.

ARTICLE 8, AMENDMENTS

Amendment 1: In a situation of National Crisis, the President or the Attorney General  may enact the Emergency Powers Act, which suspends freedom of speech,press and petition and may have anyone suspended,pending trial for Treason.

ARTICLE 9, CHECKS AND BALANCES

The government system works by passing and vetoing bills. In order for this to be successful, there must be a system of checks and balances. If the legislature passes a bill and the bill is vetoed by the executives but passed by the judiciary, then that bill will be passed even though the executives vetoed. If the legislature passes a bill and the bill is vetoed by the executives and the judiciary, then that bill will not be passed. That is the system of the checks and balances. This way no section has power above the other.

ARTICLE 10, SUMMARY OF THE NATION:

The United Servers of the DCP is a democracy government system. The president is elected(appointed in some cases), and the senators are elected as well. No man is above the law, and everyone has an opportunity in participating in the Republic.

This document is legal and can never be abolished without the approval of the President, Attorney General, Prime Minister and the Senate.
